Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the 38Hub platform and all related services (the "Service"). This AUP is incorporated by reference into our Terms of Service. By using the Service, you agree to comply with this AUP. We may update this AUP from time to time, and your continued use of the Service after such updates constitutes acceptance of the revised policy.

1. Purpose

38Hub is designed to empower content creators with AI-powered tools for ideation, writing, visual design, and publishing workflows. This Acceptable Use Policy exists to ensure that all users can enjoy a safe, productive, and respectful environment. It sets clear boundaries on what is and is not acceptable when using the Service, with particular attention to the unique responsibilities that come with AI-powered content creation.

We believe in the creative freedom of our users and aim to impose only those restrictions that are necessary to protect the safety, rights, and well-being of our users, the public, and third parties. This policy applies to all content created, stored, processed, or distributed through the Service, whether created manually or with the assistance of AI tools.

2. Prohibited Uses

You may not use the Service for any of the following purposes. This list is not exhaustive, and we reserve the right to determine, at our sole discretion, whether any use violates the spirit of this policy:

2.1 Illegal Content

You may not use the Service to create, store, or distribute content that violates any applicable local, national, or international law or regulation. This includes, but is not limited to, content that promotes or facilitates illegal activities, content that violates export control laws, and content related to the sale or distribution of controlled substances. You are responsible for ensuring that your use of the Service complies with all laws applicable in your jurisdiction.

2.2 Harassment & Hate Speech

You may not use the Service to create content that harasses, bullies, intimidates, or threatens any individual or group. This includes content that promotes discrimination, hatred, or violence against individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic. Content that incites or glorifies violence against any person or group is strictly prohibited.

2.3 Spam & Unsolicited Content

You may not use the Service to generate bulk unsolicited messages, comments, or other communications. This includes using AI features to mass-produce low-quality content designed primarily for search engine manipulation, link farming, or artificial engagement inflation. Automated posting of content to external platforms in a manner that violates those platforms' terms of service is also prohibited.

2.4 Malware & Security Threats

You may not use the Service to create, store, or distribute malicious software, scripts, or code designed to damage, disrupt, or gain unauthorized access to computer systems. You may not attempt to probe, scan, or test the vulnerability of the Service or any connected system, or attempt to breach any security or authentication measures. You may not use the Service to conduct denial-of-service attacks or other activities that disrupt the availability of the Service for other users.

2.5 Deceptive Content

You may not use the Service to create content that is intentionally misleading or deceptive, including false claims about products, services, or individuals designed to defraud or manipulate. This includes phishing content, scam pages, fake reviews, and fraudulent testimonials. Content designed to deceive people about its origin, purpose, or the identity of the person or organization behind it is prohibited.

2.6 Copyright Infringement

You may not use the Service to reproduce, distribute, or create derivative works from copyrighted material without proper authorization from the copyright holder. This includes uploading copyrighted text, images, or media to the Service without a valid license, and using AI tools to generate content that substantially reproduces copyrighted works. You are responsible for ensuring that all content you create, upload, or generate through the Service respects the intellectual property rights of others.

2.7 API Abuse

You may not attempt to circumvent rate limits, usage quotas, or other technical restrictions of the Service. You may not use automated tools, bots, or scripts to access the Service in a manner that places an unreasonable load on our infrastructure. You may not use the Service as a proxy or intermediary to access third-party APIs in a way that violates those providers' terms of service or circumvents their restrictions.

2.8 Scraping

You may not scrape, crawl, or use automated means to extract data from the Service, including user profiles, content, or any other information. You may not collect or harvest any personally identifiable information from the Service. The Service's APIs, if made available, must be used only in accordance with their documented purpose and rate limits.

3. AI-Specific Rules

The use of AI-powered features within 38Hub carries additional responsibilities. The following rules apply specifically to your use of AI content generation, scoring, and analysis features:

3.1 No Generating Harmful Content

You may not use AI features to generate content that promotes, incites, or provides instructions for violence, self-harm, terrorism, or any illegal activity. This includes using prompt engineering techniques or other methods to bypass AI safety filters in order to generate harmful outputs. If an AI feature produces harmful content unexpectedly, you must not publish or distribute that content and should report it to our team.

3.2 No Impersonation

You may not use AI features to impersonate real individuals, including public figures, without their consent. This includes generating content in the voice, style, or persona of a specific real person in a way that could reasonably mislead others into believing the content was created by that person. Parody and satire are permitted provided they are clearly labeled as such and could not reasonably be mistaken for genuine content.

3.3 No Deepfakes

You may not use AI image or video generation features to create realistic synthetic media depicting real individuals without their explicit consent. This includes manipulated images, videos, or audio that could be used to deceive, defame, harass, or embarrass real people. AI-generated visual content that depicts fictional scenarios involving real people in compromising, sexual, or degrading situations is strictly prohibited regardless of any disclaimer or labeling.

3.4 No Disinformation

You may not use AI features to generate or amplify disinformation — false or misleading information created or spread with the intent to deceive. This includes AI-generated fake news articles, fabricated scientific claims, false political content, conspiracy theories presented as fact, and health misinformation. You are responsible for fact-checking all AI-generated content before publishing, especially content that makes factual claims about real events, people, or organizations.

4. Content Guidelines

4.1 Original or Properly Licensed Content

All content you create, upload, or store on the Service should be original or properly licensed. If you use third-party content (text, images, data, etc.) as inputs for AI features or as part of your content workflow, you must have the appropriate rights or permissions to use that content. When AI generates content based on your inputs, you are responsible for ensuring the output does not infringe on the intellectual property rights of others. We recommend reviewing all AI-generated content for potential copyright concerns before publishing.

4.2 Factual Accuracy Responsibility

You bear sole responsibility for the factual accuracy of content you publish using the Service, whether written manually or generated with AI assistance. AI models can produce plausible-sounding but incorrect information, including fabricated statistics, false attributions, and invented citations. You must independently verify all factual claims, statistics, quotes, and references in AI-generated content before publishing. 38Hub provides AI as a creative tool, not as a source of truth, and we disclaim any responsibility for inaccuracies in content you choose to publish.

5. Enforcement

We take violations of this Acceptable Use Policy seriously and will take appropriate action to address them. Our enforcement approach is graduated and proportional to the severity and frequency of the violation:

Warning

For first-time or minor violations, we may issue a written warning explaining the violation and requesting corrective action. You will be given a reasonable opportunity to remove or modify the offending content. We will provide specific details about which content or behavior violated this policy and what steps are needed to come into compliance.

Suspension

For repeated violations or more serious offenses, we may temporarily suspend your access to the Service for a period ranging from 24 hours to 30 days, depending on the severity. During suspension, your data remains intact but you cannot access the Service. We will notify you of the reason for suspension and the duration via the email address associated with your account.

Termination

For severe violations, persistent repeat offenses, or violations that pose a risk to other users or the public, we may permanently terminate your account without prior warning. Terminated accounts may not be reinstated. We may also report illegal activity to the appropriate law enforcement authorities. In the event of termination, you may request an export of your non-violating content within 14 days.

6. Reporting Violations

If you become aware of any content or behavior that violates this Acceptable Use Policy, we encourage you to report it promptly. Reports help us maintain a safe and productive environment for all users. All reports are reviewed by our team and handled confidentially.

To report a violation, please contact us with as much detail as possible, including the nature of the violation, any relevant URLs or content identifiers, and the approximate date and time of the observed behavior.
